在英系法律中,有一個術語稱為 Eggshell skull rule。 翻譯過來就係「蛋殼腦袋規則」。意思是指某人好像有個「雞蛋殼那樣薄的腦袋」,看似微不足道的傷害卻會造成對該人的致命損害。
比如說,你輕輕地刮了某人一巴掌,而碰巧他擁有先天疾病,腦袋軟如蛋殼,結果他因此斃命,那麼你就必須對他的死負責。法律要求我們必須接受每個個體的特徵,即使受害人的體質不正常或過於脆弱,甚至頭蓋骨薄如蛋殼,嫌疑犯還是要對他的行為負責。
