PRC Consular Law and Practice is designed to provide participants with a comprehensive understanding of the legal framework and practical aspects governing consular affairs in the People's Republic of China (PRC). This program delves into the intricacies of consular law, exploring the rights, responsibilities, and procedures associated with consular services provided by the PRC government to its citizens abroad. Participants will study the key elements of the legal framework governing consular affairs in the PRC, including relevant international treaties, conventions, and domestic legislation.

Understanding PRC’s consular practices in Hong Kong SAR and abroad is particularly important for practitioners in law, business, journalism, policy research and consultation, and employees in international and non-government organisations. It is also valuable for government officials such as those work in the Department of Immigration or in the Hong Kong Economic and Trade Offices.


 

Programme Details

Programme Objectives

This programme aims to introduce consular laws and practice of the People’s Republic of China, with special focus on the consular practice in relation to the Hong Kong SAR and its residents.  Knowledge about China’s consular laws and practice is important as Hong Kong is an international city with high international mobility, interaction and transaction, and its residents make frequent travels to different places across the globe.

 

Intended Learning Outcomes

On completion of the programme, students should be able to:

  1. Analyse the Vienna Convention on Consular Relations 1963 and major PRC laws related to consular affairs;
  2. Examine and explain key concepts, principles and theories in consular affairs;
  3. Identify and examine various consular functions under PRC laws and the consular functions in relation to Hong Kong SAR;
  4. Analyse and explain PRC passport and visa systems.

Assessments

  • A one-hour in-class quiz (multiple choice and short questions) on concepts, principles and theories (30%); and
  • A 3,000-word individual paper on consular functions and practice (70%)

 

Award

Students who have passed all assessments and have attended not less than 70% of all scheduled classes will be awarded Certificate for Module (PRC Consular Law and Practice) within the HKU system through HKU SPACE.

 

Continuing Professional Development (CPD) Recognition

Accredited CPD Course by the Law Society of Hong Kong: upon successful completion of the Module, candidates for the Certificate for Module (PRC Consular Law and Practice) are eligible to apply for Continuing Professional Development (CPD) points under the Law Society's CPD Scheme.

Entry Requirements

Applicants shall hold:

  1. a bachelor’s degree awarded by a recognised university; or
  2. an associate degree or a higher diploma awarded by a recognised post-secondary institution.

Applicants are expected to be able to read simplified Chinese texts.
